cOde:Dress is an app published by Cahutech, Loïc Cahuzac EI (entreprise individuelle, micro-entreprise, SIREN 130 880 230), whose identification details are set out in the legal notice, that enables its users to organise their wardrobe and create outfits using features based on artificial intelligence.
The purpose of these general terms of use (hereinafter the "Terms") is to set out the conditions for accessing the cOde:Dress app and using the services offered in it.
Creating an account and using the app imply unreserved acceptance of these Terms.
The app is reserved for people aged 16 and over.
Access to the app's features requires the prior creation of a personal account.
When creating their account, the user undertakes to provide accurate information and to keep it up to date.
The account is personal to the user, who is responsible for its use and undertakes to keep their login credentials confidential.
The user retains the rights they hold over the photos they send through the app.
By sending them, the user warrants that they hold all the rights and authorisations required for their use within the app, and undertakes not to infringe the rights of third parties.
It is prohibited to send:
Photos sent and images generated by the app are subject to automated moderation.
Any photograph refused by the moderation system is not kept by the Publisher; Google, which performs this moderation, keeps it for 55 days to detect abuse of its service. How long photographs sent or saved by the user are kept depends on the feature concerned and is detailed in the Privacy policy.
If the user believes that a photograph was wrongly refused, they may use the "Report" feature available in the app or contact the Publisher at the following address: contact@cahutech.fr. The request will then be reviewed. Abusive and repeated use of the reporting system may lead to suspension of the account.
The cOde:Dress app, its general structure and all the elements it is made of, including texts, graphic elements, illustrations, logos and software components, are protected by intellectual property rights and remain the property of the Publisher.
These Terms do not grant the user any intellectual property right over the cOde:Dress app or the elements it is made of.
The name "cOde:Dress" has been filed as a French trademark with the French National Institute of Industrial Property (INPI). Any reproduction, imitation or use of this name that infringes the rights attached to the trademark is prohibited.
In connection with the use of the app, the Publisher collects and processes users' personal data in accordance with the General Data Protection Regulation (GDPR) and French law no. 78-17 of 6 January 1978 on information technology, data files and civil liberties, as currently in force.
How this data is collected and processed, and the rights users have, are set out in the Privacy policy, available from the app.
Each outfit produced by the app consumes one credit.
Free credits are granted to the user regularly. They are credited when the app is opened and do not carry over from one week to the next: a week without opening the app is not made up later.
On creating their account, the user benefits from a discovery journey that grants credits spread over seven (7) days: each day unlocks its own once a simple action is carried out in the app. This journey is offered once per device, not per account: creating a second account on the same phone does not grant it again.
Credits are also granted when the user reaches certain milestones of garments saved in their wardrobe, once per milestone.
The credit spent on an outfit whose generation fails before producing an image is given back to the user.
The user may buy additional credits or take out a subscription. Current prices are shown in the app before any purchase. Payment is collected by the App Store or Google Play, not by the Publisher, which has no access to the user's payment details. Purchased credits do not expire while the account exists. The "Restore purchases" button (Profile) restores the user's purchases after a reinstall or on a new device.
The subscription renews automatically until cancelled. The user may cancel it at any time from the "Subscriptions" section of their App Store or Google Play account; the cancellation takes effect at the end of the current period, and credits already granted remain the user's. Deleting the cOde:Dress account does not cancel the subscription: cancellation is done from the store.
To cancel: on iPhone, Settings › Apple account name › Subscriptions › cOde:Dress; on Android, Play Store › profile › Payments & subscriptions › Subscriptions › cOde:Dress. In the app, the "Manage or cancel my subscription" link (Profile → Account) opens that page directly.
Right of withdrawal: credits are granted immediately after purchase. By purchasing, the user expressly requests that immediate performance and acknowledges losing their fourteen (14) day right of withdrawal once the credits are supplied, in accordance with article L.221-28 of the French consumer code. Credits already spent are not refundable; any refund request is a matter for the store that collected the payment.
Image generation and the other features of the app that rely on artificial intelligence are currently provided by means of Google Gemini. Given the nature of this technology, the Publisher guarantees neither the quality nor the faithfulness of the generated images. In particular, they may differ from the user's expectations or not exactly match the photographs and information provided. The generation process may also fail in some cases.
Every generated image carries a visible "AI-generated image" label, as well as a marking in its metadata identifying it as artificially generated. The user undertakes not to remove or alter these labels and markings.
Any style advice offered by the app is also generated using artificial intelligence. It is provided as mere suggestions and does not constitute professional advice.
Images generated by the app are intended for personal use.
When the user's available credits are used up, the app may offer them to watch a rewarded ad in return for one credit. Watching it is optional: no ad is shown unless the user asks for it, and all other features of the app remain available without watching one. It is not offered to a user holding an active subscription.
The credit is granted only once the ad has been shown in full and confirmed by the ad network to the Publisher's servers. An ad that is interrupted, not shown or not confirmed gives rise to no credit. The user may watch at most 2 ads per day (from midnight to midnight, Coordinated Universal Time, UTC), with at least 3 hours between two ads; the app shows when a new ad becomes available.
Credits obtained this way are free: they have no monetary value and cannot be exchanged, transferred or refunded.
Ads are provided by Google (AdMob), which selects their content. They are not personalised based on the user's profile. The Publisher takes no part in choosing the ads shown and is not responsible for their content, nor for advertisers' products, services or websites. Any relationship between the user and an advertiser, in particular after a click on an ad, is solely a matter between them.
In the European Economic Area, the United Kingdom and Switzerland, showing ads requires the user's consent, collected through Google's form before the first ad. The user may change their choices at any time in "Profile → Account → Ad choices". Without consent, no ad can be offered to them, with no effect on the app's other features. The data processed on this occasion are described in the Privacy policy.
The availability of ads is not guaranteed and depends on the ad network. The Publisher may change the terms of this feature, suspend it or end it at any time; credits already granted remain acquired.
Obtaining credits by improper means is prohibited, in particular by automating views, using an emulator or software that alters how the app works, or creating several accounts. In case of fraud, the Publisher may cancel credits wrongly obtained and suspend access to this feature, or even the user's account under the conditions set out in these Terms.
The "Find this piece" button lets the user open, in their phone's browser, a Google Shopping search for a piece identified in an outfit. The search is based on a text description of that piece, which may include in particular the type of garment, its colour, its cut or its material and, where available, indications of the department and the size.
The results are provided and ranked by Google alone. The Publisher plays no part in selecting or ranking them.
The Publisher is neither a seller nor an intermediary in any transaction made following this search and receives no remuneration for it. The price, availability, conformity and delivery of the items shown are the responsibility of the merchant from whom the user makes a purchase, if any.
The Publisher strives to ensure access to the app and its proper functioning.
The Publisher does not guarantee continuous, uninterrupted availability of the app or of all its features.
Access to the app or to some of its features may be temporarily suspended or limited, in particular for maintenance, updates, technical difficulties or when certain usage limits are reached. Wherever possible, the user is informed by a message directly in the app.
The user may delete their account at any time from the "Profile" section by selecting "Delete my account". Deleting the account erases the data associated with it, under the conditions set out in the Privacy policy.
In the event of a breach of these Terms, the Publisher may suspend the user's account after informing them beforehand, except in cases of manifest abuse justifying immediate suspension.
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the French courts have jurisdiction.
In accordance with the provisions of the French consumer code on the consumer dispute mediation process, after contacting the Publisher and failing a satisfactory answer, the user may use a consumer mediation procedure free of charge with: CM2C, 49 rue de Ponthieu, 75008 Paris, tél. 01 89 47 00 14, litiges@cm2c.net, https://www.cm2c.net/declarer-un-litige.php.
These Terms may change; the version in force is the one available in the app. Any substantial change is flagged in the app.
